RE: Application of Maryland Rock Industries, Inc. for Special Exception

The undersigned are opposed to the granting of a Special Exception to Maryland Rock Industries, Inc. to allow surface mining at Douglas Point. The proposed use does not meet the requirements for a Special Exception. Among other things, there is inadequate evidence to support a finding that the proposed use meets the requirements on Article XIX for a Special Exception. We believe that:

1. The proposed operation does not meet the requirements of Section 415(h)i because it is detrimental to the health, safety and general welfare of the residents of Charles County.

2. The proposed operation does not meet the requirements of Section 415(h)iii because it will be detrimental to the use, peaceful enjoyment, economic value and development of surrounding properties and the general neighborhood.

3. The proposed project does not meet the requirements of Section 415(h)iv because it will have objectionable impacts from dust.

We request that the Charles County Board of Appeals deny the application.
